On March 19, 2020, U.S. Sen. Mark R. Warner (D-VA) and Kevin Cramer (R-ND) introduced S. 3533, the “Securing and Enabling Commerce Using Remote and Electronic (SECURE) Notarization Act of 2020”. This bipartisan legislation permits immediate nationwide use of Remote Online Notarization (RON), a type of electronic notarization where the notary and signer are not physically present in the same location during the time of signing.

In a time of social distancing, Remote Online Notarization has never been more relevant. The SECURE Notarization Act of 2020 is intended as a solution to social distancing in the Notarial world where physical presence is the only legal option in many scenarios. This bill is supported by the Mortgage Bankers Association (MBA), American Land Title Association (ALTA), and the National Association of REALTORS (NAR).

Many states, such as Florida, Nevada, Virginia, Ohio, and Texas, have already passed Remote Online Notarization legislation. These states are seeing the benefits of allowing their notaries to utilize a remote platform to perform their Notarial powers. The SECURE Notarization Act of 2020 will give those same rights to every Notary Public across the United States.
